Why this matters

Almost every template online is for a retired form

Form 12BB served for a decade, so there are thousands of copies of it. It stopped existing on 1 April 2026.

The Income-tax Act 1961 was repealed that day and the rules made under the new Act renumbered nearly everything an employer touches. The declaration form became Form No. 124 under rule 205. The obligation to collect it moved from section 192(2D) to section 392(5)(b). The deductions people call 80C now sit in Chapter VIII-A and B, as sections 123, 124, 130 and 131. We checked the notified rules directly: the string 12BB appears in them zero times.

One field on the new form is worth knowing about before you send it out. There is now a line for your relationship with the landlord, which the old form did not have. Renting from a parent or a spouse has always been allowed and has always attracted attention; what is new is that the answer is given up front, in writing, over a signature. The employee's email and phone are new too, which sounds trivial until you are chasing a declaration.

The annexures are named too, which the old form did not do. A rent agreement, documents for the leave travel claim, a loan agreement, and proof of the deductions. That removes the argument about what counts as evidence, which used to be settled differently by every employer.

One thing to settle before you collect anything: which regime each employee is on. The default regime allows no house rent allowance exemption and none of these deductions, so the form changes no tax for those people. Old name, new everything else

Five things were renumbered between the old form and the current one. If any of the left column is in your payroll notes, it is out of date.

  • Each row is a rename, with the rule or section it now lives under so you can check it against the gazette yourself.
  • The form itself follows, field by field, so it can be printed and filled in rather than retyped.
  • It ends with eleven checks for whoever accepts the declarations, because a declaration taken without evidence is the employer's problem.

6 Declaration Form Mistakes Indian Employers Make

Sending out Form 12BB

It was replaced on 1 April 2026 and the name appears nowhere in the notified rules. Collecting declarations on a retired form means collecting them again.

Collecting before asking about the regime

On the default regime there is no house rent allowance exemption and none of these deductions. Ask first and you will not collect paper from people it cannot help.

Leaving the relationship line blank

The form asks how the employee is related to the landlord, if at all. It is a new question and it is clearly there to be answered, including where the honest answer is none.

Leaving evidence undefined

The form names four annexures. A rent agreement, leave travel documents, a loan agreement and deduction proofs. Accepting a declaration without them leaves the employer holding the estimate.

Abbreviating the name or the address

The notes require the full name with no abbreviations and an address in eight specified parts, down to the post office and district. It is the commonest reason a declaration comes back.

Still calling it a financial year

The new Act works in tax years. The form asks for a Tax Year, and for income earned from 1 April 2026 that is tax year 2026-27.

Common questions

Is this declaration form template really free? +
Yes, completely. No card and no trial. The form asks for your name, work email, phone and city, then the file downloads straight away. The Attendo team may follow up about payroll software, and you are free to say no thanks.
Is Form 12BB still valid? +
No. It was replaced by Form No. 124 under rule 205 of the Income-tax Rules 2026, which came into force on 1 April 2026 alongside the Income-tax Act 2025. The words Form 12BB do not appear anywhere in the notified Rules. If you are collecting declarations for tax year 2026-27, you want Form No. 124.
What is new on Form No. 124? +
The one that matters is your relationship with the landlord, which is a new field and was not on Form 12BB at all. The employee's email and phone are also collected now, and the annexures are named, so what counts as evidence is no longer left to each employer. The landlord's Aadhaar appears as its own row rather than as an alternative to the PAN, which is how the old form put it.
Do I still need the landlord's PAN? +
Yes, where the total rent paid during the tax year exceeds one lakh rupees. That threshold has not changed. The old form asked for the PAN or the Aadhaar as alternatives; the new one lists them as separate rows. A corrigendum in April 2026 stripped Aadhaar columns out of a number of forms, but not this one. We checked the corrigendum page by page: it corrects gazette pages 1664 to 2227 and then 2401 onwards, and Form No. 124 sits on 2251.
Does this form matter if I am on the new tax regime? +
Barely. The default regime allows no house rent allowance exemption and none of the Chapter VIII-A and B deductions, so almost everything on the form is worth nothing unless the employee has opted out. Establishing which regime each person is on before collecting declarations saves collecting paper that changes no tax.
